1. Agreement to Terms

By accessing and using FI-Journey ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Age Restriction: You must be at least 18 years old to use this Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age.

2. No Financial Advice

The Service is a financial simulation and education tool provided strictly for informational purposes. It is not a financial advisor, planner, or broker. We do not act as your fiduciary, and no fiduciary relationship is created between you and us. The outcomes generated by the Service are hypothetical estimates based on user inputs and assumptions. They do not guarantee future results. You should consult with a qualified professional before making any financial decisions.

3. Subscriptions

Pro tier subscriptions are billed on a monthly basis. You may cancel your subscription at any time via your Profile page. Refunds are handled in accordance with our refund policy.

4. Limitation of Liability

To the maximum extent permitted by law, FI-Journey and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of the Service; (ii) any calculation errors, software bugs, or algorithmic inaccuracies in the simulations; or (iii) any unauthorized access to or use of our servers and/or any personal information stored therein.

WE SHALL NOT BE HELD LIABLE FOR ANY DATA BREACHES, UNAUTHORIZED ACCESS, OR LOSS OF PERSONAL INFORMATION, REGARDLESS OF THE CAUSE, INCLUDING NEGLIGENCE OR SYSTEM FAILURES.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FI-JOURNEY AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

6. Indemnification

You agree to defend, indemnify, and hold harmless FI-Journey, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

7. Governing Law & Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the the United States, without regard to its conflict of law provisions.

Mandatory Arbitration & Class Action Waiver: Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. YOU AND FI-JOURNEY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

9. General Provisions

Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Entire Agreement: These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
